A Delaware man is suing for emotional distress for allegedly waking up from a colonoscopy to find he was wearing a pair of pink, women’s underwear, Delaware Online reports.

Andrew Walls, 32, says he awoke from a colonoscopy in October 2012 and realized that the panties had been placed on his body while he was unconscious.

He is now seeking damages for mental anguish, lost wages and lowered earning capacity. He was an employee of Delaware Surgery Center when he underwent the procedure.

Walls’ attorney said that “the defendant’s extreme and outrageous conduct went beyond all possible bounds of decency,” and “’his colleagues failed to maintain proper policies and procedures for the care of patients.”

The hospital’s director of surgery Jennifer Anderson declined to comment as of Wednesday, saying that “we just found out about this yesterday afternoon.”
